Terms & Conditions

1. Work shall commence upon approval of the quotation and receipt of the agreed payment.
2. The scope of work is limited to the items specified in this quotation. Any additional requirements or work outside the agreed scope shall be subject to a separate quotation.
3. The customer shall provide all information, data, approvals, access rights, and other requirements necessary for the timely execution of the project.
4. Any delay resulting from the customer’s failure to provide the required information, approvals, or access may affect the project timeline.
5. Deliverables shall be deemed accepted if no material comments or objections are received within seven (7) days from the date of delivery.
6. Both parties shall maintain the confidentiality of all business, technical, and operational information exchanged during the project.
7. Upon full settlement of all amounts due under this quotation, the customer shall have the right to use the delivered customizations and functionalities within its own operational environment.
8. All Software Ownership Rights relating to the customizations, source code, software assets, software tools, libraries, frameworks, methodologies, reusable components, and general developments used or developed by Mast Information Technology W.L.L. shall remain the property of the service provider unless otherwise agreed in writing.
9. The customer shall not resell, distribute, sublicense, transfer, reproduce, modify for redistribution, or commercially exploit the customizations, source code, software assets, or any part thereof for the benefit of any third party without the prior written approval of Mast Information Technology W.L.L..
10. This quotation does not include the transfer or assignment of Software Ownership Rights. The customer is granted a right of use for the purpose and environment for which the solution was developed.
11. The service provider retains the right to reuse general technical knowledge, methodologies, development techniques, reusable components, concepts, and non-customer-specific developments acquired or created during the project, provided that no confidential customer information or data is disclosed.
12. Any third-party software, applications, licenses, subscriptions, APIs, hosting services, payment gateways, or other external services are subject to their respective providers’ terms and conditions and are not considered part of Mast Information Technology W.L.L.’s Software Ownership Rights.
13. Any maintenance, support, modifications, upgrades, or additional development requested after project completion shall be subject to the applicable support agreement or separate quotation.
14. The customer shall be responsible for maintaining appropriate backups of its data and operational environment. Mast Information Technology W.L.L. shall not be responsible for data loss resulting from circumstances beyond its reasonable control.
15. Mast Information Technology W.L.L. shall make reasonable efforts to deliver the agreed solution according to the approved scope and requirements. Any functionality or behavior dependent on third-party systems may be affected by changes made by those third parties.
16. All payments shall be made according to the payment terms stated in the quotation. Mast Information Technology W.L.L. reserves the right to suspend work or access to deliverables in the event of overdue payments.
17. Any dispute arising from this quotation or the related services shall first be resolved amicably between the parties. If an amicable resolution cannot be reached, the matter shall be subject to the applicable laws of the Kingdom of Bahrain.
